Secretary of Labor Ratifies Appointment of Administrative Law Judges

On Nov. 29, 2017, the Solicitor General submitted a brief in the United States Supreme Court in Raymond J. Lucia and Raymond J. Lucia Companies Inc. v. Securities and Exchange Commission, No. 17-130 (U.S.), asking the Court to decide whether the Commission's administrative law judges (ALJs) are inferior officers who must be appointed consistent with the Appointments Clause of the Constitution. The Solicitor General's brief takes the position that the Commission's ALJs are inferior officers.

To address any claim that administrative proceedings pending before, or presided over by, ALJs of the United States Department of Labor violate the Appointments Clause of the Constitution, the Secretary of Labor, R. Alexander Acosta, in his capacity as head of the Department of Labor, ratified the appointment of Chief Judge Stephen R. Henley on December 15, 2017 and of all other Department of Labor ALJs on December 21, 2017. The ratifications were effective immediately. On January 12, 2018, the Supreme Court granted certiorari in the Lucia case.

Rules of Practice and Procedure

The Department published a Final Rule on May 19, 2015, revising Subpart A of the Rules of Practice and Procedure for Administrative Hearings Before the Office of Administrative Law Judges, 80 Fed. Reg. 28767. They went into effect on June 18, 2015. Technical corrections were published on July 1, 2015. More information is found on the Rules of Practice and Procedure page.
