ORDER OF DISMISSAL
Pursuant to a Motion to Dismiss filed on behalf of the Deputy
Administrator, Wage and Hour Division, and the Board's review of
the applicable statute and regulations, it appears that the
Secretary of Labor does not have jurisdiction to waive the
liquidated damages assessed by the Environmental Protection Agency
in the amount of $11,750 for the Albert Lea contract under the
Contract Work Hours and Safety Standards Act, 40 U.S.C. 327 et seq.
Therefore, the Petition for Review filed by Moorhead
Construction Co., Inc., in this appeal is hereby dismissed.
