CCASE_NAME: RUSSELL ASSOCIATES CCASE_NO: CC-2 DDATE: 19720822 TTITLE: Final Decision TTEXT: ~1 In the Matter of RUSSELL ASSOCIATES Final Decision This is in reference to In the matter of Russell Associates an administrative proceeding on a series of allegations charging that Respondent, a subcontractor by contract with Bachman Construction dated September 23, 1970 in a HUD assisted Turnkey housing construction project, number PA-12-7, sponsored by the ontgomery County Housing Authority, violated the provisions of the subcontract dealing with Executive Order 11246 and the rules, regulation and orders issued thereunder, including what is known as the Revised Philadelphia Plan. In accordance with the Settlement Agreement and Order attached hereto and made a part hereof and pursuant to stipulation as authorized by Executive Order 11246, and the regulations and orders of the Department of Labor thereunder I order: Russell Associates, its principal officers, directors and direct or beneficial owners, shall, from the effective date of this order, be ineligible for the award of any contract or subcontract funded in whole or in part with Federal funds from any agency of the United States, or for extensions or other modifications of such existing contracts of subcontracts, until they have satisfied the Director, Office of Federal Contract Compliance that they have established and will carry out personnel and employment policies in compliance with the provisions of Executive Order 11246, or superseding Executive Orders, and rules, regulations and orders promulgated thereunder. __________________________ George Romney, Secretary Dept. of Housing and Urban Development APPROVED BY: _____________________________________ 8/22/72 Philip J. Davis, Acting Director Date Office of Federal Contract Compliance ~2 In the Matter of Docket No. CC-2 SETTLEMENT AGREEMENT AND ORDER RUSSELL ASSOCIATES, Respondent It is stipulated and agreed between the Department of Housing and Urban Development, and Russell Associates, that the rights of the parties to further hearing are hereby waived, that the hearing be terminated with respect to compliance with Executive Order 11246 (as amended), its implementing rules and regulations with respect to matters in the above-captioned proceedings; and that Russell Associates, its principal officers, directors and direct or beneficial owners, shall, from the effective date of this order, be ineligible for the award of any contract or subcontract funded in whole or in part with Federal funds from any agency of the United States, or for extensions or other modifications of such existing contracts or subcontracts, until they have satisfied the Director, Office of Federal Contract Compliance, U. S.
