Complainant has made application for the assessment against respondent of complainant's costs and expenses (including attorney fees) which he claims are in the aggregate amount of $25,281.19. In support of this application which has not been opposed by respondent, complainant submits an itemization of his costs and his counsel's charges for the various services counsel provided in connection with representing complainant in this proceeding. Having reviewed the entries contained in this application and determined that the costs incurred and the services provided by counsel were both necessary and reasonable in amount, it is recommended that, in accordance with 42 U.S.C. § 300j-9(i)(2)(B)(ii), the entire amount claimed be assessed against respondent.
It is therefore recommended that the following additional order provision be entered:
IT IS FURTHER ORDERED that the Osage Tribal Council shall pay complainant the additional amount of $25,281.19 which amount equals the aggregate amount of costs and expenses (including attorney fees) reasonably incurred by complainant in connection with bringing this action.
