The Secretary of Labor recently remanded the above matter for further consideration of the merits of timely allegations raised in the initial proceedings. On July 22, 1991 the attorney for the City of Portland advised that a settlement had been reached and requested an order so stating and dismissing the case with prejudice.
The Settlement and Hold Harmless Agreement submitted by the parties and attached hereto is found to be reasonable particularly, in view of the fact that Complainant was then, and is now, represented by counsel. Accordingly, the claims is deemed settled and is hereby dismissed with prejudice. It is so ordered.
