In the Matter of
r. BERNICE E. MALPASS
Mr. Bernice E. Malpass filed a complaint alleging that he was discharged from his employment by Fischbach and Moore, Inc., and given an unfavorable reference for other employment because of activities to carry out the purposes of the Energy Reorganization Act of 1974, as amended, in violation of Section 210 of that Act (92 Stat. 2951; 42 U.S.C. 5851).
An investigation of the allegations revealed that r. Malpass' employment was terminated for reasons unrelated to any actions on his part to carry out the purposes of the Energy Reorganization Act, and that no violation of Section 210 of that Act was committed.
Mr. Malpass and Fischbach and Moore, Inc. were advised of the results of the investigation, and an opportunity for a hearing was offered. Neither party has requested a hearing.
Accordingly, I find that it has not been shown that Section 210 of the Act was violated as alleged, and the complaint is hereby dismissed.
